Mike Tonsing (The Federal Lawyer in Cyberia column for The Federal Lawyer) is now keyboarding a monthly column for the Discovery Resources site called E-Discovery Disco. You probably want to read his premiere article, "Looking Back Before Looking Forward" which provides a very well-written, and conscise review of the evolution of e-discovery ... to arrive at the conclusion that ... "Judging from the last few efforts at reform of the FRCP, the Rulemakers may have tinkered too much." This is not to say that we necessarily agree with MT's conclusions (we will have more to say on that topic shortly) ... but it is to say that his argument is well-crafted and we consider it to be Must Reading.
