Guiding an accelerating evolution from paper-based to electronic-based discovery has now consumed three decades. Although Zubulake feels like a destination, we know it is only a prominent way-point.
In this research project, we benchmark the judiciary across federal, state and local levels as it interprets and applies rules relating to electronic discovery.
Our interests include establishing metrics for EDD matters, assessing relative familiarity and proficiency, apprehending judicial strategies and approaches, and taking a peek around the corner.
Of particular interest is the judicial view of the other StakeHolders in the EDD landscape -- when it comes to electronic discovery, is there a judicial POV about Suppliers, law firms, corporations, legislators and regulators? And how does the POV vary by level and jurisdiction?
As with each of our projects, we plot the points of intersection and disconnection between the landscape perceived by jurists and those of the other EDD StakeHolders.
